How can mediation help?

The beauty of mediation is that you stay in control. You don’t have to agree to anything you don’t want to. If no settlement is reached, your legal position won’t change.

Unlike an employment tribunal, there is no “winner” or “loser”. Mediation is all about finding out what works for all parties.

Mediation is confidential. Your customers won’t be reading about your case in the local press. It’s also much quicker and cheaper than fighting an employment tribunal.  

Agreement is usually reached in around 80-90% of mediations. In fact, mediation has such a high success rate, your (ex)employees must contact ACAS before they can raise a claim in an employment tribunal.  

What does a mediator do?

Unlike a judge, a mediator does not focus on who is right or wrong.  Instead they focus on what needs to happen to make things better for the future.

The mediator speaks to the parties involved to find out what is important to them, what the sticking points are and helps the parties reach agreement. It is non-confrontational so it can help repair broken relationships.
